They recently amended the law, it now says in art 17 para 3:
El pago se efectuará a través de medios electrónicos. Excepcionalmente, cuando alguna de las partes carezca de cuenta bancaria o acceso a medios electrónicos de pago y a solicitud de esta, se podrá efectuar en metálico y en la vivienda arrendada.
My translation:
The payment [of the rent] will be done by electronic means. Exceptionally, when one party doesn't have a bank account or access to the electronic means of payment, and at a request of said party, it will be allowed to make the payment in cash and on the leased property [means the parties should meet there].
Funny thing: any bitcoin or cryptocurrency should do. CoinJoin? PayJoin? Lightning through blinded route? Monero? All those should be ok, cannot argue that Bitcoin is not "electronic". The law says nothing about KYCed custodial account or traceability. Ironically, this law probably intends to tackle theft evasion (aka "tax evasion" in statespeak) - they want to make the landlord's income more visible.
Context: In Soviet Spain, it is already prohibited to pay more than 1000 euros in cash, with exceptions for foreigners or banks. So this is an additional restriction. Cannot pay rent in cash (even if it is 1 euro), and cannot pay 1000 eur in cash for anything.
Less funny thing: Can I pay rent by cash deposit in a bank? It is mostly done at bank's ATM, and an ATM is quite electronic. It even fulfills the probable intention of the law, as the recipient (landlord) is still identified. I started doing it recently, mostly out of spite.
Because of this idiotic formulation - what is "electronic" - I am thinking about writing the ombudsman, to file a complaint before the Constitutional Court, to strike the law down for vagueness. But not holding my breath.
Bitcoin also is an electronic transfer. Done. Fuck them.
What people still don't get is that:
  • what you do in private, stays in private
  • what you do in public, remain in public.
So where are you position yourself, when you pay the rent? Where is positioned a gov when you pay your rent? Is that gov mentioned in your renting contract as a party? No. So fuck them, is not their damn business what are you doing in private.

I just did some digging about natural marriage.
It requires both parties' consent ( with permission from the bride's father in some cultures) and two witnesses, and done! No middlemen are even needed, aka the government. 🫡

EXACTLY, you said the most important word: CONSENT. A gov cannot do any shit without your consent. But people are fooled into giving that consent (to the gov), without even knowing it. In that moment they enter in a contract with the gov and they are fucked, they must obey gov rules. Is a contractual obligation.

So if I have no bank accounts but I have access to an electronic means of payment called "Lightning Network", doesn't this law mean that landlords are obliged to accept LN payments now?

We should all pretend like lightning network is a standalone technology, not anything to do with bitcoin. That should keep the government bureaucrats confused for a few legislative sessions.

Good catch, yes, I start to wonder whether the lawmakers are that dumb, or trolling.
BTW, last year they wanted Spanish tax residents to report "their" bitcoin and cryptocurrency held in custody by foreign custodians. (For Americans, think FBAR but for bitcoin.) This included reporting public keys corresponding to my btc held at custody. Basically impossible - no 1:1 correspondence between custodian's customers and his btc addresses & pubkeys. In effect, with some exaggeration, they wanted to promote self-custody, NYKNYC. And this was before FTX crash. Don't tell me the government doesn't protect you - it does, sometimes, accidentally. :)
