This is a question that puzzles me. Evidence is mounting, regime has changed, world has moved on... yet some lawyers and deep-state types at the Attorney's office at the Southern District of New York still prosecute some random dudes for writing code...?

This morning, a letter filed by the defense of Samourai Wallet developers Keonne Rodriguez and William Lonergan Hill revealed that the Southern District of New York (SDNY) had suppressed exculpatory evidence in the criminal case.

No doubt this is a clear cut Brady violation. The judge can fashion whatever remedy he or she wants.
Regarding the prosecution, the FINCEN language

would strongly suggest that Samourai is not acting as an MSB,

gives the prosecution the loophole they probably could have used to get a conviction. It's sad to say, but as a defense attorney in the SDNY I always felt like the judge was really just a second prosecutor. I'm certain almost any sitting judge would have let the trier of fact (jury in all likelihood) decide the money transmitter issue.

All bets are off now. I'm sure the Trump DOJ, with the obvious Brady violation, means there will be a dismissal soon.
