The problem is not open source, the code is still there. The real problem is the creators behind the code. Why do you think Satoshi Nakamoto disappeared and never revealed his identity? It's the same with Samurai and its creators, they are subject to laws in their countries, governments don't want you to have privacy, it's that simple and they will attack anyone who takes away their power.
