I was watching a podcast with a well known "crypto" lawyer a few weeks ago. He differentiated the advisory nature of FinCen's guidelines from a DOJ criminal prosecution. The argument made no sense to me because the purpose of FinCen(Financial Crimes Enforcement Network) is to provide guidance on what is criminal activity.
I'm glad coincenter will probably file an amicus brief for the Samourai guys.

The government seems completely befuddled and confused. Almost like an 81 year old with dementia.
