Ah yes that is true.
But the problem with war is that it doesn't care about the rules. My answer may have been affected by current wars in the world as it was the first thing that came to my mind, sadly.

Fair enough. Remember that the whole point of this intellectual exercise is to develop a system of norms that allow conflicts to be resolved without violence.
