I mean all the things you shouldn't do with the First Amendment were all ready crimes. They are just a pain to enforce since they usually involve a court case. Even terroristic threatening has become a matter of interpretation where speech is concerned.

Do you mean that there already are plenty of checks on the First Amendment?

I imagine someone like Lummis might say that such laws are insufficient to deal with calling each other "those kinds of insane things."
